asdsaadThe qualifications for Social Security Disability Insurance (SSDI) are than rigorous Short Term Disability insurance. The Social Security application process has several built-in levels of appeal, any of which can overturn the initial decision and give you the benefits to which you are entitled.

To qualify for SSDI benefits, you must meet all of the following criteria set by Social Security Administration:

  • Worked in a job covered by Social Security and paid SSDI taxes
  • Worked in that job for 5 of the past 10 years*
  • Have a medical condition that prevents you from working and renders you disabled (according to SSA’s definition of “disabled”)

Short-term Disability Insurance in California

asdsaadCalifornia has a short-term disability insurance (SDI) program for employees.

asdsaadIt is funded by Employees through payroll deductions and can receive benefits when they are temporarily unable to work due to disability, including pregnancy.

asdsaadCalifornia’s Employment Development Department (EDD) also provides for paid family leave for employees who need time off to care for a seriously ill family member or to bond with a new child.

asdsaadAn employee is eligible for SDI if the employee is unable to work due to a disability and has lost income as a result. Employees are eligible only if they have received at least $300 in wages, from which SDI taxes were withheld, during the base period. The base period is a one-year period, usually ending just before the last complete calendar quarter before the employee filed a claim.

asdsaadSDI pays 60-70% of the wages you received during your highest-paid calendar quarter of the base period, depending on your income level. This amount is not subject to tax, so what you receive will be more than 60-70% of your usual take-home pay. If you receive any earnings while you are on SDI, that amount will be subtracted from your benefits.

To collect short-term disability benefits, you must:

  • File a claim with the state’s Employment Development Department (EDD). This needs to be done within seven weeks of becoming unable to work, or you might lose the right to benefits.
  • A medical certificate of disability signed by a duly authorized medical or religious practitioner is required.

Social Security Disability Insurance(SSDI)

asdsaadSocial Security disability benefits, including Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI), are federal programs. State Disability Insurance (SDI) benefits generally last a year or less. If you and your doctor/medical provider think that you are going to be disabled for longer than a year, you should apply for Social Security Disability Insurance (SSDI), so it can pick up where SDI leaves off. Once you have gotten SSDI benefits for 2 years, you automatically become eligible for Medicare, even if you are under age 65.

Eligibility and Application Process

In order to be eligible for SSDI you must meet both of these criteria:

  1. You must be insured. SSA will look at your work history and see if you have worked long enough to be covered by SSDI. Because it’s an insurance program, you do not have to prove financial need to qualify for SSDI.
  2. Social Security Administration will look at 5 different criteria and if you meet all 5, SSA will decide that you are disabled.

asdsaadAfter you file an initial disability application with the local Social Security Administration (SSA) the application is forwarded to the Disability Determination Service Division (DDSD where an examiner will make the medical determination as to whether you qualify for disability benefits.

asdsaadif you are denied benefits, you can appeal by requesting that DDSD reconsider your claim. If DDSD denies you again, you can request an appeal hearing in front of an administrative law judge.

REQUIRED INFORMATION:

  • Names, addresses, and phone numbers of all doctors, hospitals, and clinics that have supplied you with medical treatment and the dates of treatment
  • Names of any medications you are taking
  • Copies of any medical records you have
  • Your Social Security Number and the Social Security Numbers of your spouse and any children under the age of 18
  • A certified copy of your birth certificate
  • Proof of U.S. citizenship or legal residency, if you were born in another country
  • A certified copy of your military discharge papers (Form DD 214), if you were in the military
  • Your most recent W-2 Form or if you’re self-employed, your most recent tax return
  • Information on any workers’ compensation you get or have gotten
  • A summary of all your jobs during the past 15 years (names of jobs and dates of employment)
